These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and TheHustleDesk ("we", "us", or "our"), governing your access to and use of the TheHustleDesk platform available at thehustledesk.com. Please read these Terms carefully before using our services. By creating an account or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Description of Service

TheHustleDesk is a web-based business management platform designed for freelancers, consultants, and entrepreneurs. Our services include client management, invoice creation and tracking, contract management, expense tracking, project management, payment collection, follow-up automation, and related business tools. We reserve the right to modify, enhance, suspend, or discontinue any feature of our service at any time with reasonable notice.

2. Eligibility

• You must be at least 18 years of age to use TheHustleDesk
• You must have the legal capacity to enter into binding agreements
• If you are using the platform on behalf of a business entity, you represent that you have authority to bind that entity to these Terms
• Our services are available to users globally, subject to applicable local laws in your jurisdiction

3. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately at hello@thehustledesk.com if you suspect unauthorised access to your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Subscription Plans and Pricing

TheHustleDesk offers the following plan types:

• Free Plan: Available at no cost with limited features and usage caps as defined on our pricing page
• Paid Plans (Pro, Growth): Billed monthly or annually as selected at the time of subscription

Regarding pricing and billing:

• Subscription fees are charged in advance at the start of each billing cycle
• Prices displayed on our platform are inclusive of applicable taxes unless stated otherwise
• We may adjust pricing with 30 days' prior notice via email
• Failure to pay on time may result in suspension of your account until payment is received
• Promotional or launch pricing is valid only for the period specified and may change upon renewal
• You are responsible for all applicable taxes (GST, TDS) related to your use of our services

5. Payment Processing

Payments for subscriptions are processed securely through Razorpay, Stripe, and/or PayPal, depending on your location and preference. By making a payment, you agree to those processors' respective terms of service and privacy policies. TheHustleDesk does not store your card numbers, bank account details, or CVV. All payment data is handled by PCI-DSS compliant processors. In case of a payment dispute, please contact us at hello@thehustledesk.com before initiating a chargeback.

6. Acceptable Use

You agree not to use TheHustleDesk to:

• Violate any applicable laws, regulations, or third-party rights
• Conduct, facilitate, or promote any fraudulent, deceptive, or illegal activity
• Upload or transmit harmful, offensive, defamatory, or infringing content
• Attempt to gain unauthorised access to our systems, servers, or other users' accounts
• Reverse engineer, decompile, or attempt to extract the source code of our platform
• Use automated tools (bots, scrapers) to access our platform without authorisation
• Resell or sublicense access to our platform without our explicit written consent
• Interfere with or disrupt the integrity or performance of our services

7. Your Data and Content

You retain full ownership of all data and content you create or upload to TheHustleDesk, including client information, invoices, contracts, and business data. By using our platform, you grant TheHustleDesk a limited, non-exclusive licence to store, process, and display your data solely for the purpose of providing our services to you. We do not claim ownership over your content and will not use it for any other purpose without your consent.

8. Intellectual Property

TheHustleDesk and all its components — including software, design, logos, trademarks, and content created by us — are the exclusive property of TheHustleDesk and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our platform or content without our prior written permission. Nothing in these Terms grants you any rights to our intellectual property except as expressly set out.

9. Third-Party Integrations

Our platform may integrate with or link to third-party services (payment gateways, email providers, etc.). These third parties have their own terms and privacy policies, which you are responsible for reviewing. TheHustleDesk is not responsible for the actions, content, or practices of any third-party services.

10. Service Availability and Uptime

We strive to maintain high availability of our platform but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for any losses resulting from temporary service interruptions, scheduled downtime, or circumstances beyond our reasonable control (including internet outages, third-party service failures, or force majeure events).

11. Refunds and Cancellations

Our refund and cancellation policy is described in detail on our Refund Policy page. In summary, we offer a 7-day refund window for first-time paid subscriptions. Renewals and upgrades are non-refundable except in cases of billing errors or extended service outages attributable to us.

12. Termination

You may cancel your account at any time from your account settings.

We reserve the right to suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or present a risk to other users or our platform. Upon termination, your access to the platform ceases immediately. Your data will be retained for 30 days post-termination and then permanently deleted, unless legal retention obligations apply.

13. Disclaimer of Warranties

TheHustleDesk is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the platform will be error-free, uninterrupted, or free of viruses or other harmful components. We disclaim all implied warranties, including fitness for a particular purpose and merchantability, to the fullest extent permitted by applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable Indian law, TheHustleDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, business opportunities, or goodwill — arising from or related to your use of our services. Our total cumulative liability for any claims arising from or relating to these Terms shall not exceed the amount you paid to TheHustleDesk in the three (3) months immediately preceding the event giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold TheHustleDesk harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of our services in violation of these Terms; (b) your violation of any applicable law or third-party rights; or (c) any content you submit, post, or transmit through our platform.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.

17. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of our services after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our services and may cancel your account.
